TERMS OF SERVICE
z3Box Web Hosting

1. INTRODUCTION
These Terms of Service ("Terms") govern your use of the virtual private server (VPS) and dedicated server rental services (collectively, "the Services") provided by BSQL Networking ("we," "us," or "our") through z3Box Web Hosting. By accessing or using the Services, you agree to be bound by these Terms.

2. SERVICE DESCRIPTION
2.1 z3Box Web Hosting provides virtual private server and dedicated server rental services for hosting websites, applications, and related services.
2.2 The Services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.
2.3 The specific features, resources, and capabilities included with each Service plan are described in the service plan details provided at the time of purchase.

3. SERVICE AVAILABILITY AND TERMINATION
3.1 We reserve the right to modify, suspend, or terminate the Services, in whole or in part, at any time and for any reason, without notice or liability to you.
3.2 We may terminate your access to the Services immediately and without notice if you breach these Terms or if we determine, in our sole discretion, that your use of the Services poses a risk to the Services or other users.

4. SERVICE LEVEL AGREEMENT (SLA)
4.1 If an SLA is explicitly offered for your specific service plan, and if total service outage exceeds the SLA allowance for a given month, you will be credited for a full month of service.
4.2 To receive credit, you must submit a request within 7 days of the end of the month in which the outage occurred.
4.3 Credits are applied to future service periods and are not redeemable for cash.
4.4 SLA terms may vary between VPS and dedicated server services, as specified in your service plan details.

5. PAYMENTS AND REFUNDS
5.1 Payments for the Services are due in advance of the service period.
5.2 Refunds are only eligible for unused periods of the Services if termination is initiated by us without cause.
5.3 Refunds are not available for terminations resulting from violations of these Terms.

6. USER RESPONSIBILITIES
6.1 You agree to comply with all applicable local, state, national, and international laws and regulations, including but not limited to copyright laws, while using the Services.
6.2 You are solely responsible for the content hosted on your servers and for ensuring that such content does not violate any third-party rights.
6.3 You shall not use the Services to:
a) Engage in any illegal activities
b) Distribute malware or other harmful code
c) Host content that infringes on intellectual property rights
d) Conduct unauthorized scanning, penetration testing, or attempts to breach other systems
e) Send unsolicited bulk email (spam)
f) Overburden network resources or interfere with other users

7. SERVER MANAGEMENT
7.1 For VPS services, we provide the virtualized environment and basic infrastructure support.
7.2 For dedicated server services, unless otherwise specified in your service plan, you are responsible for server administration, security patches, and software updates.
7.3 We reserve the right to perform emergency maintenance on the physical infrastructure hosting your servers when necessary.

8. LIMITATION OF LIABILITY
8.1 BSQL Networking shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Services.
8.2 In no event shall our total liability exceed the amount paid by you for the Services during the 3-month period preceding the event giving rise to the liability.

9. INDEMNIFICATION
You agree to indemnify and hold harmless BSQL Networking and its affiliates, officers, agents, employees, and partners from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Services or your violation of these Terms.

10. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.

11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
